Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Guardian Escrow platform (“Guardian Escrow”, “we”, “us”). By creating an account or using the service you agree to these Terms.

1. The service

Guardian Escrow provides a protected-payment (escrow) facility that holds funds against agreed milestones for goods and services, and releases them once the buyer confirms delivery or a dispute is resolved. Guardian Escrow is not a bank and does not provide credit.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. We may suspend accounts that breach these Terms or applicable law.

3. Escrow transactions

  • Funds are held against the milestones defined in a transaction.
  • Release requires buyer confirmation of delivery, or resolution of a raised dispute.
  • Bank and card details are tokenised with a licensed payment partner; we do not store full account numbers.

4. Fees

Fees applicable to a transaction are shown before you fund it. Fees are quoted in South African Rand (ZAR) unless stated otherwise.

5. Acceptable use

You may not use Guardian Escrow for unlawful transactions, fraud, money laundering, or to circumvent sanctions. We may report suspicious activity to the relevant authorities.

6. Disputes

Where a buyer and provider disagree, either party may raise a dispute. Funds remain protected while the dispute is reviewed under our published dispute process.

7. Liability

To the extent permitted by law, Guardian Escrow is not liable for indirect or consequential loss. Nothing in these Terms excludes liability that cannot lawfully be excluded.

8. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction.
